Serving Forms

 Service of a Notice of Motion (Form 6) and Supporting Affidavits

 

If you filed a Notice of Motion (Form 6), you will not need to take any steps to serve it upon the other parties. The Registrar will serve the Notice of Motion (Form 6) and any supporting Affidavits (Form 10) upon all parties and other persons upon whom the Tribunal directs service.


If you filed your Notice of Motion (Form 6) without notice, the Registrar will not serve the other parties unless the Tribunal orders otherwise. For more information on a motion without notice, please consult Motion Without Notice.


Service of a Notice of Preliminary Motion (Form 7) and Supporting Affidavits

 

If you filed a Notice of Preliminary Motion (Form 7) and supporting Affidavits (Form 10), you must serve them upon all parties and other persons upon whom the Tribunal directs service.  You must serve these documents by one of the  means set out in rule 2.4.


If you filed your Notice of Preliminary Motion (Form 7) without notice, you are not required to serve it upon the other parties unless the Tribunal orders otherwise. For more information on a motion without notice, please consult Motion Without Notice.


Prepare Your Affidavit of Service


After you have served the Notice of Preliminary Motion Application (Form 7) and Affidavits (Form 10), you must prepare an Affidavit of Service (Form 9), which provides proof of service of these documents.
